Boeing Faces New Perils as Federal Prosecutors Consider Criminal Charge

Boeing, the aviation giant, is on the brink of facing new challenges as federal prosecutors contemplate reviving a criminal charge against the company. If Boeing decides to plead guilty, it could lead to a series of consequences that may further impact the company’s already-battered bottom line.

One of the major risks involved in pleading guilty is the rejection of a plea deal by a judge. This could result in hefty fines that Boeing would have to pay. Additionally, a criminal conviction could potentially restrict Boeing’s ability to contract with the federal government and secure loans, which are crucial for the company as the federal government is its largest customer and Boeing is the country’s largest exporter.

The Interagency Suspension and Debarment Committee (ISDC) could also become involved in the matter, discussing government-wide suspensions and debarments that could disrupt Boeing’s business with the US government.

The decision that Boeing faces is whether its actions leading up to a January incident involving an Alaska Airlines Boeing 737 Max 9 could lead to the revocation of legal protections extended to Boeing in a deferred prosecution agreement from January 2021. This incident followed investigations into two crashes in 2018 and 2019 that resulted in the deaths of 346 people.

While Boeing had initially agreed to certain conditions in the deferred prosecution agreement, prosecutors claimed in May that the company had violated the terms. Reports suggest that the Department of Justice (DOJ) may bring a new criminal charge against Boeing, giving the company the option to plead guilty in exchange for certain conditions.

However, the families of the victims of the Boeing 737 Max crashes have expressed concerns about a potential plea deal, describing it as a “sweetheart deal” and indicating that they would object to it. The maximum penalty for a conviction on the DOJ’s conspiracy charge is $487 million, but Boeing could receive credit for penalties it has already agreed to pay.

Ultimately, Boeing and the DOJ would need court approval to enter a plea deal, and if rejected, they would have to renegotiate terms or proceed with charges. The decision to plead guilty or risk a criminal trial is a difficult one for Boeing, especially considering its close ties with the US government.
